Tex. Transp. Code Section 311.004
Authority over Sidewalk in Home-rule Municipality

A home-rule municipality may:

(1)

construct a sidewalk;

(2)

provide for the improvement of a sidewalk or the construction of a curb under an ordinance enforced by a penal provision; or

(3)

declare a defective sidewalk to be a public nuisance.
