Tex. Transp. Code Section 112.103
Duty to Stop and Render Aid; Offense


(a)

In this section, “operator” means the person assigned by a railroad company to be responsible for the operation of a train.

(b)

An operator who is involved, while operating a locomotive, in a collision resulting in injury to or death of a person or damage to a vehicle that is driven or attended by a person shall immediately stop the locomotive at the scene of the collision.

(c)

The operator shall render to a person injured in the collision reasonable assistance, including transporting, or the making of arrangements for transporting, the person to a physician, surgeon, or hospital for medical or surgical treatment if it is apparent that treatment is necessary or if the injured person requests transportation.

(d)

A person who violates this section commits an offense. An offense under this subsection is a Class C misdemeanor.
