Exclusion of Land from District


(a)

Land may be excluded from the district in the manner provided by:

(1)

Subchapter O (Exclusion of Nonagricultural and Nonirrigable Land from the District), Chapter 51 (Water Control and Improvement Districts), Water Code; or

(2)

Subchapter J (Adding Land by Petition of Landowner), Chapter 49 (Provisions Applicable to All Districts), Water Code.

(b)

The board is not required to call or hold a hearing on the exclusion of land or other property from the district; provided, however, that the board shall hold a hearing if an owner of land or other property located in the district files a written request for a hearing with the board secretary before the district’s first bond election is called.

(c)

Subsection (b) may not be construed to prevent the board on its own motion from calling and holding an exclusion hearing under general law.
