Limited Liability for Aquatic Herbicide Application


(a)

In this section, “commercially licensed aquatic herbicide applicator” means a person who holds a commercial applicator license issued by the Department of Agriculture under Chapter 76 (Pesticide and Herbicide Regulation), Agriculture Code, that authorizes the application of aquatic herbicides.

(b)

Except as provided by Chapter 12 (Powers and Duties Concerning Wildlife), Parks and Wildlife Code, an authority employee holding a noncommercial aquatic herbicide applicator license or a commercially licensed aquatic herbicide applicator working under contract with the authority is not liable for damages in excess of $2 million for personal injury, property damage, or death resulting from the application by the applicator of aquatic herbicide in compliance with applicable law and the terms of the license or permit.
