Tex. Spec. Dist. Local Laws Code Section 8469.004
Consent of City Required

The temporary directors may not hold an election under Section 8469.003 (Confirmation and Directors’ Election Required) until:

(1)

the city has consented by ordinance or resolution to the creation of the district and to the inclusion of land in the district; and

(2)

the city and an owner or owners of land in the district have entered into a development agreement under Section 212.172 (Development Agreement), Local Government Code.
