Hearing


(a)

At the hearing, evidence shall be taken as in civil cases in the county court. The commissioners court shall hear all arguments for and against confirming the creation of the district.

(b)

The hearing may be adjourned from time to time on good cause shown.

(c)

The commissioners court shall grant the petition and order the election on the issue of confirming the creation of the district if the commissioners court finds that:

(1)

the petition is signed by the required number of registered voters;

(2)

the district will serve the purposes prescribed by Sections 3873.003 (Purpose; Declaration of Intent) and 3873.004 (Findings of Benefit and Public Purpose); and

(3)

the district includes any area within the boundaries of the city.
