Board Vacancy; Special Election


(a)

If a vacancy occurs in the office of director, the remaining directors shall appoint a director for the unexpired term.

(b)

If the number of directors is reduced to fewer than six, the remaining directors shall call a special election to fill the vacancies. If the directors do not call the election within 15 days after the vacancies occur, the county judge of Jasper County, on petition of a county voter or creditor, shall:

(1)

order a special election;

(2)

set the election date;

(3)

order a county sheriff to publish notice of the election; and

(4)

name the officers to hold the election.

(c)

For an election ordered by the county judge:

(1)

the election returns shall be made to and filed with the county clerk’s office; and

(2)

the county clerk shall declare the results.

(d)

Officers elected under this section shall furnish bond and qualify in the same manner as a director elected in a general election under this chapter.
