Tex. Prop. Code Section 71.304
State as Party in Suit for Assets


(a)

A suit brought for the collection of personal property delivered to the comptroller under this chapter must be brought in the name of this state.

(b)

A suit brought for the possession of real property held in trust by the Commissioner of the General Land Office under this chapter must be brought in the name of this state.
