Tex. Prop. Code Section 70.104
Persons Who May Bind Vessel


(a)

The following persons are presumed to be authorized by the owner of a vessel to incur charges that give rise to a lien under this subchapter:

(1)

the managing owner;

(2)

the ship’s husband;

(3)

the master;

(4)

the local agent; and

(5)

a person entrusted with management of the vessel at the port of supply.

(b)

A person tortiously or unlawfully in possession or charge of a vessel may not bind the vessel.
