Denial of a Permit
(1)
it finds that the reclamation as required by this chapter cannot be accomplished by means of the proposed reclamation plan;(2)
part of the proposed operation lies within an area designated as unsuitable for surface mining in Sections 131.035 (Rules Designating Unsuitable Land) through 131.041 (Applicability of Subchapter) of this code;(3)
it is advised by the Texas Natural Resource Conservation Commission that the proposed mining operation will cause pollution of water of the state, or that the proposed mining operation will cause pollution of the ambient air of the state, in violation of the laws of this state;(4)
the applicant has had another permit issued under this chapter revoked or any bond posted to comply with this chapter forfeited and the conditions causing the permit to be revoked or the bond to be forfeited have not been corrected to the satisfaction of the commission;(5)
it determines that the proposed operation will endanger the health and safety of the public;(6)
the surface mining operation will adversely affect a public highway or road; or(7)
the operator is unable to produce the bonds or otherwise meet the requirements of Sections 131.201 (Performance Bond Requirement) through 131.206 (Increase or Decrease of Bond) of this code.
