Tex. Ins. Code Section 38.051
Definition


In this subchapter, “health benefit plan provider” means an insurance company, group hospital service corporation, or health maintenance organization that issues:

(1)

an individual, group, blanket, or franchise insurance policy, an insurance agreement, a group hospital service contract, or an evidence of coverage, that provides benefits for medical or surgical expenses incurred as a result of an accident or sickness; or

(2)

a long-term care benefit plan, as defined by Section 1651.003 (Long-term Care Benefit Plan Defined).
