Tex. Ins. Code Section 2209.301
Scope of Coverage


(a)

The pool shall insure a nonprofit organization and the organization’s officers and employees against liability for acts and omissions under the laws of this state.

(b)

The pool shall provide to a nonprofit organization that qualifies under this chapter and the plan of operation:

(1)

primary liability insurance coverage in an amount not to exceed $250,000; and

(2)

excess liability insurance coverage in an amount that the board finds is actuarially sound.

(c)

The pool may participate in evaluating, settling, and defending a claim against a nonprofit organization insured by the pool if the claim is covered by pool coverage.

(d)

The pool is liable in an amount not to exceed the limit of coverage provided to a nonprofit organization on a claim made against the organization.
