Tex. Ins. Code Section 2208.002
Pool Not Engaged in Business of Insurance

(a)

Except as provided by Subsection (b), the pool is not engaged in the business of insurance under this code or other laws of this state, and the department has no jurisdiction over the pool.

(b)

The pool is subject to Chapter 541 (Unfair Methods of Competition and Unfair or Deceptive Acts or Practices).
