Deficit Recoupment
(a)
This section applies to a deficit sustained in a single year by the association with respect to:(1)
physicians and health care providers, other than nursing homes and assisted living facilities; or(2)
a nursing home or assisted living facility.(b)
The deficit must be recouped in accordance with the plan of operation and the rating plan in effect when the deficit is sustained under one or more of the following procedures, in this sequence:(1)
a contribution from the policyholder’s stabilization reserve fund established under Section 2203.301 (Policyholder’s Stabilization Reserve Fund for Physicians and Certain Health Care Providers) or the policyholder’s stabilization reserve fund established under Section 2203.303 (Policyholder’s Stabilization Reserve Fund for Nursing Homes and Assisted Living Facilities), as appropriate, until the respective fund is exhausted;(2)
an assessment on the policyholders in accordance with Section 2203.252 (Assessment of Policyholders for Deficit Recoupment); or(3)
an assessment on the members in accordance with Sections 2203.055 (Joint Underwriting Association Membership)(c) and (d) and 2203.253 (Limitation on Reimbursement by Member for Deficit Recoupment).
