Tex. Ins. Code Section 1504.003
Violation of Chapter: Relief Available to Injured Person

A benefit plan issuer that violates this chapter is subject to the same penalties, and an injured person has the same rights and remedies, as those provided by Subchapter D (Private Action for Damages Authorized), Chapter 541 (Unfair Methods of Competition and Unfair or Deceptive Acts or Practices).
