Tex. Human Resources Code Section 73.010
Eligibility for Services

A child is eligible for services under this chapter if the child:

(1)

is under three years of age; and

(2)

is documented as having developmental delay or has a medically diagnosed physical or mental condition that has a high probability of resulting in developmental delay.
