Human Resources Code Section 31.0035
Transitional Child-care Services
(a)
The Texas Workforce Commission shall provide necessary transitional child-care services, in accordance with Texas Workforce Commission rules and federal law, to a person who was receiving financial assistance under this chapter but is no longer eligible to receive the assistance because:(1)
the person’s household income has increased; or(2)
the person has exhausted the person’s benefits under Section 31.0065 (Time-limited Benefits).(b)
Except as provided by Section 31.012 (Mandatory Work or Participation in Employment Activities Through Temporary Assistance for Needy Families Employment Program)(c), the Texas Workforce Commission may provide the child-care services only until the earlier of:(1)
the end of the applicable period prescribed by Section 31.0065 (Time-limited Benefits) for the provision of transitional benefits; or(2)
the first anniversary of the date on which the person becomes ineligible for financial assistance because of increased household income.(c)
The Texas Workforce Commission by rule shall adopt a system of copayments in order to have a person who receives child-care services under this section contribute an amount toward the cost of the services according to the person’s ability to pay.(d)
The Texas Workforce Commission by rule shall provide for sanctions for a person who is financially able to contribute the amount required by Subsection (c) but fails to pay.
