Tex. Human Resources Code Section 23.004
Initiation of Proceeding


(a)

The commission may initiate a proceeding to suspend a person’s license by filing a petition with the commission’s appeals division.

(b)

The proceeding shall be conducted by the commission’s appeals division. The proceeding is a contested case under Chapter 2001 (Administrative Procedure), Government Code, except that Section 2001.054 does not apply.

(c)

The executive commissioner or the executive commissioner’s designated representative shall render a final decision or order in the proceeding. A reference to the commission in this chapter with respect to a final decision or order in the proceeding means the executive commissioner or the executive commissioner’s designated representative.
