Tex. Health & Safety Code Section 753.010
Civil Penalty


(a)

A person who violates a rule adopted under this chapter is liable to the state for a civil penalty of not more than $100 for each day the person violates the rule.

(b)

The civil penalty is recoverable in a district court in:

(1)

Travis County;

(2)

the county in which the person resides; or

(3)

the county in which the violation occurs.

(c)

At the board’s request, the attorney general shall institute and conduct a suit in the name of the state to recover the penalty.

(d)

The civil penalty provided by this section may be in addition to or in lieu of the criminal penalty prescribed by Section 753.011 (Criminal Penalty).
