Health & Safety Code Section 31.007
Application for Services
(a)
The executive commissioner shall adopt rules relating to application procedures for admission to the program.(b)
An applicant must complete or cause to be completed an application form prescribed by the department.(c)
The application form must be accompanied by:(1)
a statement by the applicant, or by the person with a legal obligation to provide for the applicant’s support, that the applicant or person is financially unable to pay for all or part of the cost of the necessary services; and(2)
any other assurances from the applicant or any documentary evidence required by department rules that is necessary to support the applicant’s eligibility.(d)
Except as permitted by department rules, the department may not provide services or authorize payment for services delivered to an individual before the eligibility date assigned to the individual by the department.(e)
The department shall determine or cause to be determined the eligibility date in accordance with department rules. The date may not be later than the date on which the individual submits a properly completed application form and all supporting documents required by this chapter or department rules.
