Tex. Health & Safety Code Section 254.053
License Application and Issuance


(a)

An applicant for a license under this chapter must submit an application to the department on a form prescribed by the department.

(b)

Each application must be accompanied by a nonrefundable license fee in an amount set by the executive commissioner by rule.

(c)

The application must contain evidence that there is at least one physician and one nurse on the staff of the facility who are licensed by the appropriate state licensing board.

(d)

The application must contain evidence that the facility meets the minimum standards and requirements specified in Section 254.151 (Minimum Standards).

(e)

The department shall issue a license if, after inspection and investigation, it finds that the applicant and the facility meet the requirements of this chapter and the standards adopted under this chapter.

(f)

The license fee must be paid on renewal of the license. The term of a license issued under this chapter is two years.
