Tex. Health & Safety Code Section 251.052
Disclosure of Unannounced Inspection; Criminal Penalty


(a)

A person commits an offense if the person intentionally, knowingly, or recklessly discloses to an unauthorized person the date or time of or any other fact about an unannounced inspection of an end stage renal disease facility before the inspection occurs.

(b)

In this section, “unauthorized person” does not include:

(1)

the department;

(2)

the Health and Human Services Commission, including the office of the inspector general;

(3)

the office of the attorney general; or

(4)

any other person authorized by law to make an inspection or to accompany an inspector.

(c)

An offense under this section is a Class B misdemeanor.

(d)

A person convicted under this section is not eligible for state employment.
