Tex. Health & Safety Code Section 104.005
Limitations on Powers of Department

This chapter does not authorize the department or an official or employee of the department to:

(1)

supervise or control the practice of medicine, the manner in which physician’s services in private practice are provided, or the selection, tenure, compensation, or fees of a physician in the delivery of physician’s services; or

(2)

perform a duty or function under Title XI of the Social Security Act (42 U.S.C. Sec. 1301 et seq.) or a rule or regulation adopted under that Act.
