Buyer’s Acknowledgment of Delivery of Contract Copy

(a)

Any retail buyer’s acknowledgment of delivery of a copy of a retail installment contract must:

(1)

be in at least 10-point type that is bold-faced, capitalized, or underlined or otherwise conspicuously set out from the surrounding written material; and

(2)

appear directly above the buyer’s signature if the acknowledgment is contained in the contract.

(b)

Any retail buyer’s acknowledgment conforming to this section of the delivery of a copy of the retail installment contract is, in any action or proceeding:

(1)

presumptive proof of the delivery of a copy of the contract and compliance with any requirement relating to the completion of the contract before execution of the contract by the buyer; or

(2)

conclusive proof of the delivery of a copy of the contract and compliance with any requirement relating to the completion of the contract before execution of the contract by the buyer if the holder purchased the contract without knowledge to the contrary.
