Tex. Est. Code Section 1203.107
Appointment on Removal of Litigation Conflict


The court may appoint as successor guardian a spouse, parent, or child of a proposed ward who was disqualified from serving as guardian because of a litigation conflict under Section 1104.354 (Conflict of Interest)(1) on the removal of the conflict that caused the disqualification if the spouse, parent, or child is otherwise qualified to serve as a guardian.
