Feasibility of Video and Audio Equipment and Recordings for Motor Vehicle Stops


(a)

In this article:

(1)

“Law enforcement agency” has the meaning assigned by Article 2B.0053 (Law Enforcement Policy on Racial Profiling).

(2)

“Motor vehicle stop” has the meaning assigned by Article 2B.0051 (Definitions).

(b)

On adoption of a policy under Article 2B.0053 (Law Enforcement Policy on Racial Profiling)(b), a law enforcement agency shall examine the feasibility of:

(1)

installing video camera and transmitter-activated equipment in each agency law enforcement motor vehicle that is regularly used to make motor vehicle stops;

(2)

installing transmitter-activated equipment in each agency law enforcement motorcycle regularly used to make motor vehicle stops; and

(3)

equipping with a body worn camera, as that term is defined by Article 2B.0101 (Definitions), each peace officer who regularly detains or stops motor vehicles.

(c)

If a law enforcement agency installs video or audio equipment or equips peace officers with body worn cameras as provided by this article, the policy adopted by the agency under Article 2B.0053 (Law Enforcement Policy on Racial Profiling)(b) must include standards for reviewing video and audio documentation.
