Tex. Code of Crim. Proc. Article 29.01
By Operation of Law


Criminal actions are continued by operation of law if:

(1)

The individual defendant has not been arrested;

(2)

A defendant corporation or association has not been served with summons; or

(3)

There is not sufficient time for trial at that term of court.
