Leases Subject to Other Laws
(a)
A lease, although subject to this chapter, is also subject to any applicable:(1)
certificate of title statute of this state, including Chapter 501 (Certificate of Title Act), Transportation Code, Chapter 31 (Water Safety), Parks and Wildlife Code, and Subchapter E (Definitions), Chapter 1201 (Manufactured Housing), Occupations Code;(2)
certificate of title statute of another jurisdiction (Section 2A.105 (Territorial Application of Chapter to Goods Covered by Certificate of Title)); or(3)
consumer law of this state, both decisional and statutory, including, to the extent that they apply to a lease transaction:(A)
Titles 6, 7, 8, 9, and 14;(B)
Subtitle A, Title 11;(C)
Chapters 17 (Deceptive Trade Practices), 53 (Store Leases), 54 (Compensation Agreements for Sales Representatives), 72 (Business Records), 92 (Rental-purchase Agreements), 101 (International Matchmaking Organizations), 103 (Appraisals Improperly Induced by Mortgage Lenders), 305 (Telephonic Communications Made for), 323 (Provision of Software or Services to Block or Screen Internet Material), 522 (Identity Theft by Electronic Device), 523 (Provisions Relating to Victims of Identity Theft), 602 (Delivery of Unsolicited Goods), 603 (Regulation of Consumer Contracts Created by Acceptance of Check or Other Draft), 604 (Sale or Issuance of Stored Value Card), and 2001 (Destruction of Die, Mold, or Form);(D)
Section 65.017 (Cigarette Seller, Distributor, or Manufacturer), Civil Practice and Remedies Code;(E)
Chapter 1201 (Manufactured Housing), Occupations Code; and(F)
Chapter 25 (Notice of Construction of Wireless Communication Facility), Transportation Code.(b)
In case of conflict between this chapter, other than Sections 2A.105 (Territorial Application of Chapter to Goods Covered by Certificate of Title), 2A.304 (Subsequent Lease of Goods by Lessor)(c) and 2A.305 (Sale or Sublease of Goods by Lessee)(c), and any statute or law referred to in Subsection (a), the statute or law controls.(c)
Failure to comply with any applicable statute has only the effect specified therein.
