Tex. Agric. Code Section 146.008
Penalty for Transporting Animals Without Permit or with Fraudulent Permit


(a)

A person commits an offense if, under Section 146.005 (Permits to Transport Animals) of this code, the person:

(1)

transports living animals, slaughtered animals, or butchered portions of animals without possessing a permit;

(2)

fails to exhibit a permit or provide a statement on demand;

(3)

transports living animals, slaughtered animals, or butchered portions of animals that are not covered by a permit;

(4)

possesses a false or forged permit; or

(5)

provides a false written statement.

(b)

An offense under Subsection (a)(1) or (a)(2) of this section is a misdemeanor punishable by a fine of not less than $25 nor more than $200 for each animal in the shipment.

(c)

An offense under Subsection (a)(3) of this section is a misdemeanor punishable by a fine of not less than $25 nor more than $200 for each animal that is not covered by the permit.

(d)

An offense under Subsection (a)(4) or (a)(5) of this section is a misdemeanor punishable by:

(1)

a fine of not less than $200 nor more than $500;

(2)

confinement in county jail for not less than 60 days nor more than 6 months; or

(3)

both fine and confinement under this subsection.
