Tex. Local Gov't Code Section 118.134
Payment of Costs Incurred for Care of Certain Property

(a)

A sheriff or constable may keep possession of property legally acquired until the party seeking to replevy the property pays the officer’s costs incurred for the storage, security, or management of the property.

(b)

Subsection (a) of this section does not apply to costs incurred on property seized in conjunction with an offense alleged under the Penal Code, Code of Criminal Procedure, or Title 116, Vernon’s Texas Civil Statutes, when the owner of the property is subsequently found to be not guilty of an offense or other proscribed activity described in those statutes, or if other charges whether criminal or civil are dropped.
