Tex. Health & Safety Code Section 146.007
Compliance with Chapter and Rules


(a)

A person who owns, operates, or maintains a tattoo or body piercing studio or practices tattooing or body piercing at a temporary location shall comply with this chapter, Chapter 431 (Texas Food, Drug, and Cosmetic Act), and rules adopted under this chapter and Chapter 431 (Texas Food, Drug, and Cosmetic Act).

(b)

The department may enforce Chapter 431 (Texas Food, Drug, and Cosmetic Act) in relation to a drug, cosmetic, or device that is used in tattooing and that is not otherwise subject to that chapter as if the drug, cosmetic, or device satisfied the definitions assigned those terms under Section 431.002 (Definitions).
