Tex. Gov't Code Section 615.001
Definition


In this chapter, “minor child” means a child who:

(1)

on the date of the death of an individual listed under Section 615.003 (Applicability), is younger than 18 years of age; and

(2)

if the child is not a biological or adopted child, was claimed as a dependent on the federal income tax return of an individual listed under Section 615.003 (Applicability) for the year preceding the year of the individual’s death.
