Divisions of Commission
(a)
The executive commissioner shall establish divisions within the commission along functional lines as necessary for effective administration and for the discharge of the commission’s functions.(b)
The executive commissioner may allocate and reallocate functions among the commission’s divisions.(c)
Notwithstanding Subsections (a) and (b), the executive commissioner shall establish the following divisions and offices within the commission:(1)
a medical and social services division;(2)
the office of inspector general to perform fraud and abuse investigation and enforcement functions as provided by Subchapter C and other law;(3)
a regulatory division;(4)
an administrative division; and(5)
a facilities division for the purpose of administering state facilities, including state hospitals and state supported living centers.(d)
Subsection (c) does not prohibit the executive commissioner from establishing additional divisions under Subsection (a) as the executive commissioner determines appropriate. This subsection and Subsection (c) expire September 1, 2023.(b)
The commission shall explore and evaluate new developments in medical technology and propose implementing the technology in Medicaid, if appropriate and cost-effective.(c)
Commission staff implementing this section must have skills and experience in research regarding health care technology.
