Tex. Gov't Code Section 469.152
Waiver or Modification Prohibited


The commission may not waive or modify a standard or specification if:

(1)

the waiver or modification would significantly impair the acquisition of goods and services by persons with disabilities or substantially reduce the potential for employment of persons with disabilities;

(2)

the commission knows that the waiver or modification would result in a violation of the Americans with Disabilities Act of 1990 (42 U.S.C. Section 12101 et seq.) and its subsequent amendments; or

(3)

the proof presented to the commission under Section 469.151 (Waiver or Modification Permitted)(a)(2) is not adequate.
