Tex. Gov't Code Section 418.123
Recommendations for Changes in Land Use or Construction Standards

(a)

The division shall recommend to the governor the changes it considers essential if the division believes, on the basis of the studies under Section 418.122 (State Study of Land Use and Construction Standards) or other competent evidence that:

(1)

an area is susceptible to a disaster of catastrophic proportions without adequate warning;

(2)

existing building standards and land-use controls in that area are inadequate and could add substantially to the magnitude of the disaster; and

(3)

changes in zoning regulations, other land-use regulations, or building requirements are essential to further the purposes of this subchapter.

(b)

The governor shall review the recommendations. If after public hearing the governor finds the changes are essential, the governor shall make appropriate recommendations to the agencies or local governments with jurisdiction over the area and subject matter.

(c)

If no action or insufficient action pursuant to the governor’s recommendations is taken within the time specified by the governor, the governor shall inform the legislature and request legislative action appropriate to mitigate the impact of the disaster.
