Tex. Gov't Code Section 401.061
Appropriations for Emergency


The legislature may appropriate money to the governor to be used only:

(1)

in an emergency, including an imperative public necessity;

(2)

for the executive branch of state government;

(3)

if other money is not available, because previously appropriated money has been spent or obligated; and

(4)

for purposes for which specific other appropriations previously have been made.
