Tex. Gov't Code Section 4008.104
Statute of Limitations


(a)

A person may not sue under Section 4008.101 (Investment Adviser or Investment Adviser Representative Liability)(a) more than three years after the date the violation occurs.

(b)

A person may not sue under Section 4008.101 (Investment Adviser or Investment Adviser Representative Liability)(b) more than:

(1)

five years after the date the violation occurs; or

(2)

three years after the date the person knew or should have known, by the exercise of reasonable diligence, of the occurrence of the violation.
