Tex. Gov't Code Section 4008.001
Unenforceability of Illegal Contracts


A person may not base a suit on a contract if the person:

(1)

made or engaged in the performance of the contract in violation of this title or a rule, order, or requirement under this title; or

(2)

acquired any purported right under the contract with knowledge of the facts by reason of which the contract’s making or performance was in violation of this title or a rule, order, or requirement under this title.
