Gov't Code Section 33.033
Notification to Complainant
(a)
The commission shall promptly notify a complainant of the disposition of the case.(b)
The communication shall inform the complainant that:(1)
the case has been dismissed;(2)
a private sanction or order of additional education has been issued by the commission;(3)
a public sanction has been issued by the commission;(4)
formal proceedings have been instituted; or(5)
a judge has resigned from judicial office in lieu of disciplinary action by the commission.(c)
The communication may not contain the name of a judge unless a public sanction has been issued by the commission or formal proceedings have been instituted.(d)
If a public sanction has been issued by the commission, the communication must include a copy of the public sanction.(e)
If the complaint is dismissed by the commission, the commission shall include in the notification under Subsection (a):(1)
an explanation of each reason for the dismissal, including, as applicable, in plain, easily understandable language, each reason the conduct alleged in the complaint did not constitute judicial misconduct; and(2)
information relating to requesting reconsideration of the dismissed complaint as provided by Sections 33.035 (Reconsideration of Complaint)(a) and (f).
