Tex. Gov't Code Section 3100.072
Limitations on Governmental Subdivision or Agency


(a)

A governmental subdivision or agency may not enact or enforce a law that prohibits:

(1)

the display of:

(A)

a municipal flag;

(B)

the state flag;

(C)

the flag of another state of the United States;

(D)

the United States flag; or

(E)

the flag of a nation other than the United States; or

(2)

any conduct covered by this subchapter.

(b)

This section does not prohibit a governmental subdivision or agency from enacting or enforcing a law to protect the public health or safety.
