Tex. Gov't Code Section 2308.268
Assistance and Sanctions for Nonperformance

(a)

The council shall provide technical assistance to local workforce development areas that do not meet performance standards established under this chapter and other applicable federal and state law.

(b)

If a local workforce development area does not meet performance standards for two consecutive program years, the council shall develop and impose a reorganization plan that may include:

(1)

restructuring the board;

(2)

prohibiting the use of designated service providers, including state agencies; and

(3)

merging the local workforce development area with another area.

(c)

If nonperformance is directly attributable to a specific state agency, the council may select an alternative provider.

(d)

A local workforce development area that is the subject of a reorganization plan may appeal to the governor to rescind or revise the plan not later than the 30th day after the date of receiving notice of the plan.
