Tex. Gov't Code Section 2267.0065
Special Board of Review

(a)

If the local government denies the rezoning request submitted under this chapter, the matter may be appealed to a special board of review consisting of the following members:

(1)

the land commissioner;

(2)

the mayor of the municipality within whose corporate boundaries or extraterritorial jurisdiction the real property is located;

(3)

the county judge of the county in which the qualifying project is located;

(4)

the executive director of the state entity that proposes to develop or operate the qualifying project; and

(5)

a member appointed by the governor.

(b)

The land commissioner shall serve as the presiding officer of the special board of review.
