Tex. Gov't Code Section 2167.052
Leasing Space from Private Source

(a)

Space may be leased from a private source through:

(1)

competitive bidding;

(2)

competitive sealed proposals under Section 2167.054 (Leasing Space Through Competitive Sealed Proposals); or

(3)

direct negotiation.

(b)

The commission may negotiate for space on making a written determination that competition is not available.

(c)

The commission shall use the method for leasing space that provides the best value for the state.
