Authority to Adopt Rules


(a)

The comptroller may adopt rules to efficiently and effectively administer this chapter. Before adopting a rule under this section, the comptroller must conduct a public hearing regarding the proposed rule regardless of whether the requirements of Section 2001.029 (Public Comment)(b) are met.

(b)

The comptroller shall follow the procedures prescribed by Subchapter B (Petition for Adoption of Rules), Chapter 2001 (Administrative Procedure), when adopting a new rule or a change to an existing rule that relates to historically underutilized businesses.
