Tex. Gov't Code Section 1507.157
No Waiver of Claims


(a)

A municipality’s action under this subchapter does not affect or abrogate any claim the municipality may have with respect to a loss described by Section 1507.151 (Authority to Issue Bonds).

(b)

A municipality that issues bonds under this subchapter:

(1)

does not waive any claim of the municipality;

(2)

is not estopped from recovering on a claim of the municipality; and

(3)

does not ratify any prior action by the municipality in connection with the loss.

(c)

A municipality may reserve any claim the municipality may have in its action authorizing the bonds.
