Tex. Civ. Practice & Remedies Code Section 147.046
Failure to Give Notice


(a)

On motion of the defendant that the claimant did not give the notice under Section 147.044 (Notice), the court shall:

(1)

abate the action; and

(2)

require the claimant to give the notice before the 31st day after the date of the order of abatement.

(b)

The court shall dismiss the claimant’s action if the claimant does not give notice as required by Subsection (a)(2).
