Tex. Bus. & Com. Code Section 92.156
Authorized Exclusions

A loss damage waiver may exclude:

(1)

loss or damage to the merchandise that is caused by an unexplained disappearance or abandonment of the merchandise;

(2)

damage that is intentionally caused by the consumer; or

(3)

damage that results from the consumer’s wilful or wanton misconduct.
