Tex. Gov't Code Section 24.021
Incompetency


For purposes of Article XV, Section 6, of the Texas Constitution, “incompetency” means:

(1)

gross ignorance of official duties;

(2)

gross carelessness in the discharge of official duties; or

(3)

inability or unfitness to promptly and properly discharge official duties because of a serious mental or physical defect that did not exist at the time of the judge’s election.
