Tex. Est. Code Section 22.007
Court; County Court, Probate Court, and Statutory Probate Court


(a)

“Court” means and includes:

(1)

a county court in the exercise of its probate jurisdiction;

(2)

a court created by statute and authorized to exercise original probate jurisdiction; and

(3)

a district court exercising original probate jurisdiction in a contested matter.

(b)

The terms “county court” and “probate court” are synonymous and mean:

(1)

a county court in the exercise of its probate jurisdiction;

(2)

a court created by statute and authorized to exercise original probate jurisdiction; and

(3)

a district court exercising probate jurisdiction in a contested matter.

(c)

“Statutory probate court” means a court created by statute and designated as a statutory probate court under Chapter 25 (Statutory County Courts), Government Code. For purposes of this code, the term does not include a county court at law exercising probate jurisdiction unless the court is designated a statutory probate court under Chapter 25 (Statutory County Courts), Government Code.
