Records

(a)

Each person subject to a marketing agreement or license shall:

(1)

maintain records reflecting the person’s operation under the agreement or license;

(2)

permit the department to inspect those records; and

(3)

furnish to the department information requested by the department relating to the person’s operations under the agreement or license.

(b)

Except as otherwise provided by this subsection, information obtained under this section is confidential and may not be disclosed to any person. The information may be disclosed to a person with a similar right to obtain the information or to an attorney employed by an administrative committee to give legal advice on the information. In addition, the information may be disclosed in response to a court order.
